NEW DELHI: The Supreme Court on Wednesday said it is “very much concerned” about the 8-month-old girl who was raped in Delhi and directed AIIMS to immediately send two competent doctors for her treatment.
It has also sought a report on her medical condition by tomorrow.
The doctors will supervise the case and thereafter take a decision on whether to shift her to the premier medical facility. In case the infant cannot be shifted, the doctors shall tender personal assistance to her, the bench headed by Chief Justice Dipak Misra said while hearing a PIL.
The court also ordered the National Legal Services Authority to assist in the case, and fixed the matter for further hearing on February 1.
Filed by lawyer Alakh Alok Srivastava, the petition also seeks urgent framing of guidelines on investigation and trial of cases involving rape of children aged between 0-12 years, so they should be completed maximum within six months from the date of filing FIR.
“As of now,Protection of Children from Sexual Offences (POCSO) Act only provide maximum punishment of life imprisonment. So I have said that rape cases in which there is victim of 0-12 years of age, max punishment should be death penalty,” Srivastava told ANI.
The baby was raped by her 28-year-old cousin in northwest Delhi’s Netaji Subhash Place. She was admitted to a hospital in north Delhi, where she underwent a three-hour-long surgery on Tuesday due to severe injuries to her private parts. Hospital authorities said she is still in the ICU but her condition is stable.
Delhi Commission For Women chief Swati Maliwal had earlier visited the infant at the hospital. In a series of tweets on Tuesday, Maliwal expressed her anguish over the incident and reiterated demands to punish rapists within six months.
The accused was arrested after he confessed to raping the baby on Sunday under the influence of alcohol.
The girl’s parents used to go out for work and leave their daughter in the custody of their sister-in-law. Since it was a Sunday, their sister-in-law’s son was at home, he said.
When he saw that his mother was not around, the accused allegedly forced himself on the baby, police said.
The girl’s mother, who works as a maid, returned home around 12.30 pm. She saw blood stains on her daughter’s clothes and informed her husband.
